OVERVIEW

This website, www.deadgrace.com (the “Site”), is operated by GK Entertainment LLC. Throughout the Site, “we”, “us” and “our” refer to GK Entertainment LLC. We offer the Site, including all information, tools, and services available on it, on the condition that you accept these Terms of Service (“Terms”), along with the policies they reference, including our Privacy Policy.

By visiting the Site, joining our mailing list, or buying something through it, you agree to these Terms. If you do not agree, please don’t use the Site. New features added to the Site are also subject to these Terms.

SECTION 1 — USING THE SITE

You may not use the Site for any illegal or unauthorized purpose, or violate any laws in your jurisdiction (including copyright laws) in using it. You must not transmit any worms, viruses, or code of a destructive nature. Breaking these Terms may result in your access being ended immediately.

SECTION 2 — GENERAL CONDITIONS

We may refuse service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any part of the Site without our express written permission. Headings in these Terms are for convenience only.

SECTION 3 — MUSIC, PHOTOS, AND OTHER CONTENT

The music, recordings, artwork, logos, names, and other content on the Site belong to DEADGRACE, GK Entertainment LLC, or their licensors, and are protected by copyright and trademark law. Photographs are owned by the photographers credited with them. You may share links to the Site, but you may not download, reproduce, or reuse content beyond what your browser needs to display it, unless we say otherwise in writing.

SECTION 4 — ACCURACY AND TIMELINESS OF INFORMATION

We try to keep the Site accurate, but we are not responsible if information on it is not accurate, complete, or current. Show dates, venues, line-ups, and times can change or be cancelled, so confirm details with the ticket seller or venue before you travel. Some material is historical and provided for reference only. We may change the Site’s content at any time, but we have no obligation to update it.

SECTION 5 — TICKETS AND MERCH

Tickets are sold by third-party ticketing companies and venues, not by us. Your purchase, prices, fees, refunds, and entry are governed by that seller’s terms, and questions about a ticket should go to the seller. Merch is sold through our Shopify store. Prices, availability, shipping, and returns are shown at checkout and governed by that store’s terms and policies. Prices may change without notice, and we may limit quantities or discontinue items at any time.

SECTION 6 — MAILING LIST

If you join our mailing list, we will email you about DEADGRACE music, shows, and merch. You can unsubscribe at any time using the link in any email. How we handle your email address is described in our Privacy Policy.

SECTION 7 — THIRD-PARTY LINKS AND TOOLS

The Site includes links to, and embedded content from, third parties such as ticket sellers, streaming services, and social networks. We don’t control or evaluate them and are not responsible for their content, products, services, or practices. Any use of them is at your own risk and subject to their terms. Complaints, claims, or questions about third-party products should be directed to the third party.

SECTION 8 — COMMENTS, FEEDBACK, AND OTHER SUBMISSIONS

If you send us creative ideas, suggestions, proposals, or other materials, whether online, by email, by post, or otherwise (“comments”), you agree that we may, at any time and without restriction, edit, copy, publish, distribute, translate, and otherwise use them in any medium. We are under no obligation to keep comments confidential, to pay for them, or to respond to them. You agree that your comments will not violate anyone’s rights, will not contain unlawful, abusive, or obscene material or malware, and will not mislead anyone about who sent them.

SECTION 9 — PERSONAL INFORMATION

Your submission of personal information through the Site is governed by our Privacy Policy.

SECTION 10 — ERRORS, INACCURACIES, AND OMISSIONS

The Site may occasionally contain typographical errors, inaccuracies, or omissions, including in show details, product descriptions, prices, and availability. We may correct them and change or update information at any time without prior notice.

SECTION 11 — PROHIBITED USES

In addition to the other prohibitions in these Terms, you may not use the Site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or take part in unlawful acts; (c) to violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances; (d) to infringe our intellectual property rights or those of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or other malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Site or any related website. We may end your use of the Site for violating any of these prohibitions.

SECTION 12 — DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee that the Site will be uninterrupted, timely, secure, or error-free, or that results obtained from it will be accurate or reliable. We may remove the Site for indefinite periods or cancel it at any time without notice.

Your use of the Site is at your sole risk. The Site and everything provided through it are provided “as is” and “as available”, without any representation, warranties, or conditions of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

In no case shall GK Entertainment LLC, DEADGRACE, or our members, directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data, or replacement costs, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of the Site or any content or product obtained through it, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in those places our liability is limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless GK Entertainment LLC, DEADGRACE, and our affiliates, partners, members, officers, directors, agents, contractors, licensors, service providers, subcontractors, and suppliers from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

SECTION 14 — SEVERABILITY

If any provision of these Terms is found unlawful, void, or unenforceable, it will still be enforced to the fullest extent permitted by law, and the unenforceable portion will be severed without affecting the validity of the remaining provisions.

SECTION 15 — TERMINATION

Obligations and liabilities incurred before termination survive it. These Terms remain in effect until ended by you or us. You may end them at any time by no longer using the Site. If we believe you have failed to comply with these Terms, we may end them at any time without notice and deny you access to the Site.

SECTION 16 — ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms is not a waiver of it. These Terms and any policies we post on the Site are the entire agreement between you and us about the Site and supersede any prior agreements, communications, and proposals. Any ambiguities will not be construed against the drafting party.

These Terms are governed by and construed in accordance with the laws of the United States.
